Meeting:        Salem Licensing Board was held Monday, March 25, 2013 at 6:00 pm in the third floor conference room, 120 Washington Street. Present were Chairman Bob St. Pierre and members John Casey and Rick Lee, Det. Sgt. Page and Clerk of the Board, Melissa Pagliaro and City Solicitor, Beth Rennard.
                
Approved:       Application for a One Day Liquor License. Applicant: George McCabe from North shore Bartending.
        Mr. McCabe said the event was for complimentary beer & wine for an event on Thursday for about 75 people at the Salem Five Community Room for the Campaign kickoff for the YMCA.
        Mr. Lee seconded.
        Mr. St. Pierre said all are in favor. Motion carried.

Approved:       Application for two One Day Liquor License and a revote for an application submitted last month on day of the meeting. Applicant: Anne Busteed for Hamilton Hall.
        Ms. Busteed said the events are for April 20th and 21st and are both typical wedding receptions.
        Ms. Rennard said that she would like the Board to take another vote of approval on a license from last meeting because it had not been posted on the Agenda. The event is at Hamilton hall on March 30th, 2013.
        Mr. Casey motioned to approve both applications for sub-licensees reader’s licenses.
Mr. Lee seconded.
Mr. St. Pierre said all are in favor. Motion carried.

Approved:       Application for a One Day License. Applicant: Leonora Lewis for SSU.
        Ms. Lewis said this is for an Alumni BBQ for upperclass students to be held on May 1st, 2013 for about 75-100 people at the Bates Complex. She said she will send the insurance and they are all set with campus police and Chartwell’s is catering.
        Mr. Casey motioned approve.
                Mr. Lee seconded.
                Mr. St. Pierre said all are in favor. Motion carried.

Approved:       Application for two sub licensee fortunetelling licenses at Magika, 63R Wharf Street. Applicants: Jackie Alloise and Bradley Bendetti.
        Mr. Casey said that both approvals are pending CORI’s.
        Mr. Alloise said she has read before for Crow Haven Corner and she does Tarot Cards.
        Mr. Bendetti said he has not read in Salem before but he has in Boston. He said he also does Tarot Cards.
                Mr. Casey motioned approve.
                Mr. Lee seconded.
                Mr. St. Pierre said all are in favor. Motion carried.

Approved:       Applications for various Street performers. Applicants that showed were Laura DiRoberts and Charles Spencer.
                Ms. DiRoberts said that she is going to dress in costume and pose as a witch.
                Mr. Casey asked if she read and signed the rules and regs.
                Ms. DiRoberts said she did read and sign and that she has not performed in Salem before.
                Mr. Spencer said that he sings and plays the guitar and mandolin and also read the rules and regulations.
                Mr. Casey said he is aware then that there is to be no amplification.
                Mr. Casey motioned approve.
                Mr. Lee seconded.
                Mr. St. Pierre said all are in favor. Motion carried.
                



Approved:       Application for a Class II Auto Dealers License. Applicant: Salvatore Martinez for Sal Auto Gallery at 87 Jackson Street.
        Mr. Casey confirmed that he would now have this location and 142 Canal Street.
                Ms. Rennard said it was up to the Board based on each individual application.   
Mr. Casey said he knows the applicant is already aware of the rules and regulations and that he has done a good job at running his business. He said just to be sure the cars at that location are behind the white lines for the safety of the school children in that area.
Mr. Martinez said the hours would be 7 days a week from around 9am-7pm and would most likely close earlier on Sundays.  
                Mr. Casey motioned approve the lot for 15 cars as it previously was.
                Mr. Lee seconded.
                Mr. St. Pierre said all are in favor. Motion carried.

Approved:       Application for Change of Corporation on a package Store License for Wine & Malt. Applicant: Tedeschi Food Mart, 72 Loring Ave.
                Mr. Chowdury said it is currently run as an Individual but that he wishes to change it to a Corporation.
                Mr. Casey said that all the paperwork to submit to the ABCC is in order.
                Mr. Casey motioned approve.
                Mr. Lee seconded.
                Mr. St. Pierre said all are in favor. Motion carried.

Approved:       Application to amend a Class I Auto Dealers License. Applicant: Hometown auto Framingham d/b/a Mazda, 309-311 Highland Ave.  Present: Darin Bonano, Manager.
        Mr. Bonano said that the applciatio0n is to extend the property to Lot #575 as shown on the plot plan that was submitted. The LB reviewed the plot plan. He said that this lot would be used to store vehicles. He said the building on it is not equipped with phones or computers or anything else so there really is no other user for the Lot. He said it is for space and parking.
        Ms. Rennard read the summary of Attorney Nathanson sent to the LB on this request into the record. * See file for full set of comments.
Mr. St. Pierre said per one of Attorney Nathanson’s comments the LB voted to remove item # 2 on the City’s requirement sheet to obtain a Class I, II or III Auto Dealers License.
Ms. Rennard continued to read from the memorandum. She said that several parents and employees wrote in to display the issues at Young World Academy. *Letters in file.  
Mr. St. Pierre asked if Mr. Theolopolous would like to speak on the matter.
Mr. Theolopolous said that he is concerned with all the issues that parents and teachers spoke about in their letters. He said that he has to provide a safe place for kids from the lot into the school. He said that with illegal turns, speeding cars, truck carriers, etc. he cannot do that. He said there are too many vehicles on the site as it is. He said he is also concerned about the transfer station situation because that could add even more traffic. He said he feels that the LB should consider access issues. He said he has included photos to substantiate what he is saying. He said he is generally concerned about access without interference.
Ms. Rennard said that the amendment does not add any more vehicles to the number on the license.
Mr. St. Pierre asked if using DiPietro Ave. to alleviate some of the issues is possible.
Mr. Bonano said that there is a pitch on that road and it could be just as dangerous having carriers drop cars off there.
He said he would like to quickly address couple of other things discussed. He said he does not think there is a line on the road, therefore he said that no one is ever probably on the correct side of the road when traveling on that road.  He said that the truck drivers are told what they can and cannot do. He said he is only hearing some of these issues for the first time tonight.
Mr. Casey asked if he had had any telephone call from YWA about these issues.
Mr. Bonano said that he was not aware of any calls to him regarding these issues unless they were not given to him.
He said he does not condone any trucks going onto YWA property. He said he feels that Lot #575 may help alleviate some of the issues YWA has.  
Mr. Casey asked if it was possible for him to put that statement in writing to the LB, that there will be no additional cars and Lot used only for parking and storage.
Sgt. Page asked if there was any chance that the car carriers would be able to use the Lot to unload, even if they have to drive over a curb to enter or exit the lot.
Mr. Bonano said he and Mr. Shaker had this discussion. He said he is not sure because there is a building on the corner but they had the same idea and will work with it if they can.
Ms. Rennard suggested that if the LB approves the application that out a requirement on it addressing some of the items talked about tonight and have Mazda start working on those ideas.
Mr. St. Pierre did say that he agreed strongly that trucks or vehicles cannot be trespassing on property and asked Mazda to get that across to the car carriers.
Mr. Lee suggested that all manifest for drives have a note attached to them letting them know not to go onto YWA property.
Mr. St. Pierre said that maybe and employee of Mazda could meet them to direct them.
Mr. Bonano said he will do everything he can to resolve any issues.
Mr. St. Pierre asked if Traffic Division would be of any help in this situation.
Sgt. Page said he did not think so. He said this is already a high traffic area with issues, and the street is not owned by the City.
Mr. Theolopolous said he has talked to Mr. Shaker and Mr. Bonano and they are on OK terms. It’s just the situation that is still bad.  He said that the street was filled with vehicles during any snow storms. He said he is not trying to beat them up but the street was completely blocked during the snow. He said last week and enraged driver drove the wrong way up Highland Ace. He said his concerns are big ones. He said the reason they are in litigation to begin with is because Stutz did not take a lot of things into consideration. He said there were all kinds of problems with Stutz and this dealer is very large compared to Stutz.
Mr. St. Pierre said that he does not want to get into that again because this request is not for any additional cars and all of this information was gone over with the initial application.
Mr. Theolopolous said outing cars in Lot #575 might create more traffic if they are being moved back and forth.
He said the street has certain rights and it is still in litigation.  
Mr. St. Pierre said for tonight he only wants to concentrate on this one lot.
Mr. Casey suggestions to approve the application are Memos on all manifests and signage regarding trespassing
Mr. Theolopolous said he feels it would not hurt to reduce the number of vehicles they have there now.
Mr. St. Pierre said that is not the issue before the LB tonight and closed the public discussion portion.
Ms., Rennard re-read the recommendations of the Board.
Mr. Casey motioned approve.
